DID THE DEPUTIES BOTCH THE CASE?The Insite has talked with sources who have seen all three police video tapes involving the arrest of Mayor Bill White's teen daughter Elena. Those who have laid eyes on the tape say it is one of the worst DWI stops they've ever seen. They describe it as extremely sloppy police work. At one point during the tapes the deputy constables are allegedly heard saying they can't really tell if the 17 year old girl was drunk at all. They reportedly went on to say they will just take her down to jail and if she blows past the legal limit she will be charged with drunken driving. If Elena doesn't then they will charge her with minor under the influence. My sources who actually laid eyes on the 3 tapes also say White was never read her rights and the field sobriety test was poorly handled. Also several portions of the video tape were allegedly obstructed by deputies from precinct 5 who were reportedly out joking and seem to be having a good time. Also I'm told young White wasn't properly questioned until after being handcuffed/arrested and I'm told whatever she said will likely be inadmissible in court. Those sources also say this dwi case would never make it to trial but because it is the Mayor's daughter the District Attorney's office doesn't want to be perceived as playing favorites...White is scheduled back in court in February!

She shouldn't be given special treatment because her father is the mayor. nor should she be treated harsher (harsly, more harshly ?) because her father is the mayor.
first, they didn't have to read her her rights.....people watch too much tv....you really don't have to read peoples rights all that often....i have arrested several hundred people and read the miranda warning to less than five of those.......what people are forgetting is that she is a MINOR and that to be DWI, she only has to have a MEASUREABLE amount of alcohol to be DWI and that means if the officers even smelled it on her breath......should be a slam dunk case no matter what the video shows.........Isiah...do a little more research...gettinga a DWI conviction on a minor is easier than an adult....and yes...17 is a minor in the state of texas

The charge of DWI is the same for both adults and minors.
A minor can be charged with Minor Operating a Motor Vehicle Under the Influence if they are under .08, but they cannot be charged with DWI if they are under the legal limit. All that is required for this Class C charge is that officer were able to detect the odor of an alcoholic beverage on her breath by any means.
In this case, she did not provide a breath sample. She is being charged with DWI, not the minor offense.
Since she did not provide a breath sample, the State must be able to prove she did not have the normal use of her mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of
two or more of those substances, or any other substance into her body. (Chapter 49, Texas Penal Code)
If the officers made statements on video about not knowing whether she was DWI or a Minor Driving Under the Influence, then the State will not be able to prove DWI.
If this was a "normal" DWI case, it would have already been dismissed.
I'd be surprised if Rusty Hardin doesn't ask the judge to dismiss the case (at the start of the trial) for lack of probable cause to charge her with DWI in the first place."

a DWI will never ruin a rich white girls life. good for her that her dad is the mayor and can afford a big shot attorney.
If its a bad charge, then it should be dropped. She should be allowed to get on with the rest of her life.
As for others, who may face a bogus charge, dwi or otherwise, and who don't have an important father with deep pockets, good luck to them.
