WHAT'S REALLY GOING ON IN AMERICA?

I was watching one of those conservative talk shows Saturday when the host was interviewing a guest. The host said he went to a gun store and it was packed. Packed with people I assume who are all of sudden afraid of the government now that President Barack Obama is in office. The host said he wanted to make sure he didn't frighten people but he told them to be prepared because the GOVERNMENT could show up at your door and you should be ready to defend yourself. But then he said you shouldn't use your gun. Is it that bad to those who are unhappy with the new President? What happen to the people who stood behind their country no matter what? I also saw a program a couple of weeks ago all these same kind of folk said they wanted to leave the country because President Obama was elected. What do you really think all of this is about? The Insite wants to hear your honest opinion. If you want to go anonymous on this one to get your true feelings out do and just about anything will be approved as a comment!

PAUL HARVEY DIES AT 90!

THIS IS PAUL HARVEY....GOOD DAY!

Radio legend Paul Harvey, whose news and commentary segments always ended with his distinctive sign-off, "Paul Harvey....good day," died today at the age of 90, ABC Radio Network says.

Network spokesman Louis Adams says Harvey died Saturday at his winter home in Phoenix, surrounded by family. No cause of death was immediately available.

Harvey never viewed himself as a newsman, even though some 18 million people tuned into his daily reports to hear his 15-minute take on the day's events.

"I'm a professional parade watcher who can't wait to get out of bed every morning and rush down to the teletypes to pan for gold," he told CNN's Larry King in 1988.

That he did with a vengeance since those teletype days in 1951, arriving at his Chicago studio in the pre-dawn hours to produce two news and commentary segments and his evening The Rest of the Story (written by his son, Paul) which were carried on some 1,100 radio stations and 400 Armed Forces Radio Network stations.

American Express Co, battered by mounting credit card losses, is offering $300 to a limited number of U.S. card holders who pay off their balances and close their accounts, the company said on Monday.

"We sent the offer out to a select number of card members," said Molly Faust, a company spokeswoman. "We are looking at different ways that we can manage credit risk based on the costumers overall credit profile."

The company did not say how many card holders would receive the offer and did not disclose the total of their card balances.

Card holders have until the end of February to accept the offer and must close their accounts in March or April. Each card holder will receive a $300 pre-paid American Express card.

American Express, often seen as catering to relatively wealthy customers and companies, has been expanding its credit card business in recent years by reaching out to a wider range of clients.

But that strategy has backfired. The company's earnings tumbled in the fourth quarter as credit losses jumped and debt-burdened consumers slashed spending.

In addition, American Express reported last week that credit card delinquencies rose in January more than analysts expected, as U.S. unemployment increased and the global economy deteriorated.

The Insite had the opportunity to serve as the moderator during a 6 hour long panel discussion at Texas Southern University. It was part of the Historically Black Colleges and Universities Film Festival. It was the 5th year the event was put on here in Houston. The event was organized by entertainment attorney Carol Guess and music video director / producer John 'Dr. Teeth' Tucker. Dozens of young people who are hoping to get a career in film attended the event. They heard from panelists who have made their mark or continue to do so in the movie biz. On the list of attendees were: Daniel Gomez (Cane and Abel), Jesse Terrero (Soul Plane), Ron Finburg (Producer), Owners of AllHipHop.com, Tray Chaney (The Wire), Joyce Barrett, John Guess and the list goes on. The event was a huge success and next year's fest will be held at Prairie View!

LOUISIANA GOVERNOR CAUGHT LYING TO THE NATION!

MANY ARE ASKING NOW CAN ANYTHING HE SAYS BE TRUSTED IF HE LIED TO THE NATION?

Remember that story Bobby Jindal told in his big speech Tuesday night -- about how during Katrina, he stood shoulder-to-shoulder with a local sheriff who was battling government red tape to try to rescue stranded victims?

Turns out it wasn't actually, you know, true.

(A) Jindal spokeswoman has admitted to Politico that in reality, Jindal overheard Lee talking about the episode to someone else by phone "days later." The spokeswoman said she thought Lee, who died in 2007, was being interviewed about the incident at the time.

This is no minor difference. Jindal's presence in Lee's office during the crisis itself was a key element of the story's intended appeal, putting him at the center of the action during the maelstrom. Just as important, Jindal implied that his support for the sheriff helped ensure the rescue went ahead. But it turns out Jindal wasn't there at the key moment, and played no role in making the rescue happen.

There's a larger point here, though. The central anecdote of the GOP's prime-time response to President Obama's speech, intended to illustrate the threat of excessive government regulation, turns out to have been made up.

UPDATE: I'd initially misunderstood (Jindal spokesperson Melissa) Sellers to be saying Jindal and Lee didn't meet while rescue efforts were still underway. In fact, she said, the conversation took place in the aftermath of the storm, but after the boat incident.

"Bobby and I walked into harry lee's office - he's yelling on the phone about a decision he's already made," Jindal chief of staff Timmy Teepell recalled. "He's saying this is a decision I made, and if you don't like it you can come and arrest me."

Teepell said the exchange took place in the week following Katrina, when Jindal visited Jefferson Parish multiple times.

"He was boots on the ground all the time," he said.

This doesn't seem to bear on the key question. As we said, the key elements of Jindal's story were that he was in Lee's office during the crisis itself, and that his support for the sheriff helped ensure the rescue went ahead. Neither of those things was true, it now seems.

PARKER: WE WANT HOUSTON'S CUT!

WAITING ON THE BIG STIMULUS CHECK!

City Controller Annise Parker called on Governor Rick Perry today to give Houston its fair share of federal stimulus dollars controlled by the state government, and to open up the process for deciding how the dollars are spent.

“Governor Perry’s priorities have not always been Houstonians’ priorities,” said Parker. “From the failed Trans-Texas Corridor, to threatening to turn away a portion of federal stimulus dollars intended for Texas, we’ve seen that the Governor’s priorities do not always help Houston.”

As an example, Parker cited a move this week by the Texas Department of Transportation, controlled by Perry, to shut local leaders out of the decision making process for spending Texas’ share of transportation funds from the stimulus program. TXDOT was supposed to vote today on allocating the funds, but legislators from the House committee overseeing Texas stimulus funds forced a delay in the vote to allow more input.

“Houston’s representatives in Austin need to have input in how these dollars are spent in order to make sure that Houston gets its fair share of funds,” said Parker. “In these tough economic times, we need to put these dollars to work creating good jobs in Houston – in health care, public education and transportation projects.”

“Frankly,” Parker continued, “Perry’s office has shown its willingness to railroad through his agenda. We have to make sure our representatives are at the table too.”

Parker said she will meet with members of the legislature in Austin next week about the use of state-controlled stimulus funds.

Parker concluded: “When Governor Perry finally accepted the federal money, he warned the President that he ‘would work to ensure that [Texas] citizens receive their fair share.’ Governor Perry should be on notice we’re fighting for Houstonians’ fair share as well.”

THE HESP UNION CELEBRATES BLACK HISTORY WITH THE INSITE!

The Insite along with cohort Duarte Geraldino took part in the 19th annual HESP union Black History Month Celebration. The union represents several support workers like custodians and bus drivers in the Houston Independent School District. Dozens of people showed up for the event which was held at the CEP campus on Beechnut. It was designed to honor those here in Houston who served their community in their various professions. I served as master of ceremonies while Duarte and I were both given honors for our work in the news biz. On hand for the event were: HESP President Wretha Thomas, Teacher's Union Prez Gayle Fallon, Velma Russell, Ronald Green, John Guess, Dr. Uzziah Grigsby (Keynote Speaker), HISD Board Member Paula Harris, Civil Rights Activist Tammy Campbell. THE ARRESTS IN THE STANFORD CASE HAVE BEGUN!

Laura Pendergest-Holt, the chief investment officer of Stanford Group, was arrested on charges of obstruction by FBI agents in Houston on Thursday, the U.S. Justice Department said.

She made an initial appearance in U.S. federal court, it said.

U.S. securities regulators have charged the firm's chairman, Allen Stanford, with an $8 billion fraud.

BRADFORD MAKES HIS NEXT POLITICAL MOVE!

HE'S RUNNING FOR RONALD GREEN'S OLD SEAT!

Less than four months after losing a close race for Harris County district attorney, former Houston Police Chief C.O. Bradford is running for an at-large seat on the City Council.

Bradford is aiming for the at-large Position 4 seat being vacated by Ronald Green, who is running for controller. Other candidates for the council job include Noel Freeman, an administrator for the city engineer. The election is Nov. 3, and candidates have until late September to sign up.

Bradford, a lawyer and security consultant, indicated in a written statement Wednesday that he is launching his second candidacy within two years because he wants to serve the public again.

“It is certainly an honor to serve in the public sector. Making a difference for the greater good of all is a tremendous reward,” he said. “As Houston moves forward, we must get better prepared to deal with issues such as public safety, budget restraints, critical infrastructure repairs, representation via council redistricting and many others.”

With about 1 million votes cast in the race for district attorney in November, Bradford, the Democratic nominee, lost by about 5,000 votes to Republican Pat Lykos.

Bradford served as police chief from 1997 to 2003, when he retired amid a series of controversies, including errors and faked results by police crime lab personnel.

I recently read a comment on the Insite left by a self righteous reader. That reader basically chastised anyone who happens to associate with a rapper. Specifically, the anonymous reader was referring to Houston rapper Slim Thug. He or she essentially said they wouldn't want to be associated with him. I thought about the comment as I approved it. Then I realized this reader is probably a person who would rather be associated with someone who is well educated, rich, respected in the community, and on every 'A' list in town. Then I thought about all the people who would've made it on that list at some point. The list is pretty exclusive and long: Ken Lay, Bernie Maddoff, Sir Allen Stanford, Jeffrey Skilling, Paul Greenwood, Stephen Walsh, Andrew Fastow and the list goes on. At one point all these were very well respected people in various communities. Men millions of people in some form of fashion looked up to and adored. These are also the men who have been found guilty or are currently accused of making a plum fool out of those who trusted them. Then I realized I'd probably prefer being friends with Slim Thug who may have used the 'F' and 'N' word in a song but he didn't steal my retirement and walked way with my entire financial future. Just a thought from The Insite!

HUNDREDS OF MILLIONS OF DOLLARS STOLEN FROM INVESTORS AGAIN!

THE PEOPLE YOU TRUST WITH YOUR MONEY!

Lev L. Dassin, the Acting United States Attorney for the Southern District of New York, and Joseph M. Demarest, Jr., the Assistant Director-in-Charge of the FBI’s New York Field Division, announced today that Paul Greenwood, 61, of North Salem, N.Y., and Stephen Walsh, 64, of Sands Point, N.Y., were arrested this morning on conspiracy, securities fraud and wire fraud charges.

According to a three-count complaint unsealed today in Manhattan federal court, from at least 1996 through February 2009, Greenwood and Walsh ran a fraudulent commodities trading and investment advisory scheme using an entity they controlled called WG Trading Investors. Through a marketer, Greenwood and Walsh solicited investor funds on the understanding that they would invest the funds in a program called “enhanced stock indexing,” which they represented was a conservative trading strategy that had outperformed the results of the S&P 500 Index for more than 10 years.

Several institutional investors – including charitable and university foundations, retirement and pension plans and others – invested more than $668 million through WG Trading Investors, receiving in exchange promissory notes issued by WG Trading Investors that the defendants represented would pay interest at a rate equal to the investment returns earned by the enhanced stock indexing strategy.

Contrary to their representations to their investors, Greenwood and Walsh are alleged to have misappropriated the majority of the investor funds. Among other things, Greenwood is alleged to have used the funds to purchase expensive collectible items and horses, as well as for other personal expenditures. Walsh is alleged to have misappropriated investor funds for himself, and to have made large cash payments to his ex-wife.

Both Greenwood and Walsh executed promissory notes in favor of WG Investors with respect to the investor funds they misappropriated and to conceal trading losses. These promissory notes totaled approximately $293 million for Greenwood and approximately $261 million for Walsh.

In February 2009, the National Futures Association (NFA) conducted an audit of WG Investors and related entities. In the audit, the NFA discovered that of approximately $812 million purportedly on the books of WG Investors, more than $794 million was booked as receivables due from Greenwood and Walsh and investments in entities that they controlled.

The charges contained in the complaint are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

Greenwood and Walsh surrendered this morning to the FBI and are expected to be presented today before United States Magistrate Judge Douglas F. Eaton in Manhattan federal court.

Greenwood and Walsh are each charged with one count of conspiracy to commit securities fraud and wire fraud, one count of securities fraud, and one count of wire fraud. The conspiracy count carries a maximum sentence of five years in prison and a maximum fine of $250,000, or twice the gross gain or loss from the offense. The securities fraud count carries a maximum sentence of 20 years in prison and a maximum fine of $5 million, or twice the gross gain or loss from the offense. The wire fraud count carries a maximum sentence of 20 years in prison and a maximum fine of $250,000, or twice the gross gain or loss from the offense.

Mr. Dassin praised the investigative work of the FBI in this case, and thanked the Securities and Exchange Commission, the United States Commodity Futures Trading Commission and the NFA for their assistance. He added that the investigation is continuing.

INSITE COOK OF THE WEEK: MIYA SHAY!

SHE'S DOING MORE THAN JUST KICKING DOWN DOORS FOR THE SCOOP!

I was pleasantly surprised when I tasted some food cooked by ace street reporter Miya Shay of KTRK-TV. She baked up these cool and elaborate finger foods for a birthday party last weekend. When I ran into her she asked me to try some. Now, when I think of Miya, I think of a very busy professional woman who doesn't have much time for the kitchen. I imagine her kicking down doors to get the scoop then heading to some fancy restaurant to eat for dinner after work. So, when I accepted her offer to sample her food I didn't expect much. But after eating some of the fancy edibles I was surprised and all of them were great. DELICIOUS! I even went back for more. The only problem, I just can't seem to remember the name of the hors d'oeuvres. Way to go Miya and with your skills you become the Insite Cook of The Week!

RACISM AT THE HOUSTON LIVESTOCK SHOW AND RODEO?

SHOULD THERE BE MORE DIVERSITY AT THE RODEO OR IS TRADITION JUST TRADITION?

The Hispanic and African American communities are protesting the lack of diversity within the Houston Livestock Show & Rodeo. A press conference is scheduled for Friday, February 27, at 10:30 a.m. at the Harris County Administration Building located at 1001 Preston. Everyone is welcome to support the cause.

A protest at Reliant Stadium is scheduled for Friday, March 13, at 5:00 pm. The performer for that evening will be Clint Black.

The Houston Livestock Show & Rodeo was established in 1931 and has used government facilities since 1938. Millions of tax dollars have been used to create venues and provide year-round office space for the rodeo. For this reason, leaders from both communities feel the rodeo should be inclusive of all communities.

At the press conference, the following issues will be addressed:

1. Board Members

There are 320 board members at the Houston Livestock Show & Rodeo, of which 233 are voting board members and only 7 are minorities. The process of becoming a board member is dependent on being a big donor, serving on the Houston Livestock Show & Rodeo Committee for decades, or being recommended by the executive board members. There are many minorities that have volunteered for the rodeo for decades, yet they have never been recommended to serve as board members.

2. Board Executives

There are 42 executives on the Houston Livestock Show & Rodeo board, which includes 17 vice-presidents. Of the 42, there is only one minority. By the way, the rodeo will consistently show him in the press to show they are diverse. Why don’t they show the other 41 executives on television?

3. Full-Time Employees

There are 90+ full-time employees at the Houston Livestock Show & Rodeo. There are only 7 minorities, which are groundskeepers and other low level employees. The rodeo executives have consistently hid the salaries of employees for their own benefit. They do not wish to show anyone their hefty 6-figure salaries. The rodeo is a non-profit organization using government property. There should be no reason to hide these facts.

4. Scholarships

The Houston Livestock Show & Rodeo will bring in approximately $120 million in 2009 and yet it only has committed to award $11 million in scholarships, which amounts to 9% of the total funds collected. An organization that claims to be all about scholarships is really a money-making machine for those in leadership positions.

5. Concerts

The Houston Livestock Show & Rodeo has 20 concerts per year. One day is dedicated to Hispanics and one day is dedicated to African-Americans. Are we to celebrate this?

6. Contracts

This year approximately $50 million will be awarded in contracts by the Houston Livestock Show & Rodeo. Has anyone seen a Request for Proposals distributed to the community? I didn’t think so. There is no process in place to ensure minority contractors and vendors have a fair opportunity to bid on any of the contracts associated with the rodeo. It is the good ole boy network at its best.

7. Pay Parity

The average attendance for the concerts at the Houston Livestock Show & Rodeo is 55,000 a concert. Go Tejano Day (now called Hispanic Heritage Day) averages almost 70,000. Go Tejano Day has consistently broken attendance records throughout the years and yet the artist performing on that day have consistently been paid much less than their counterparts. The average pay for a performer for each performance is between $750,000 and $1,000,000. Little Joe, a Tejano music legend, was paid $40,000 for a concert.

8. Open Records

The Houston Livestock Show & Rodeo has consistently avoided being transparent to the citizens of Harris County. Basic information has been requested year after year and every time we are given excuses. What is there to hide?

9. Selection of Artists

The selection of entertainers is done by Houston Livestock Show & Rodeo executives with no input from the Go Tejano Committee or the Black Heritage Committee. I guess this executive committee knows it all.

THEY'VE INDICTED A TEXAS MAN FOR SENDING THAT WHITE POWDER IN THE MAIL!

MICHAEL JUREK HAS BEEN INDICTED!



A federal grand jury in Amarillo returned an indictment today charging Richard Goyette, a/k/a Michael Jurek, 47, with one count of threats and false information and 64 counts of threats and hoaxes, announced acting U.S. Attorney James T. Jacks of the Northern District of Texas. Goyette has been in federal custody since his arrest on February 2, 2009, on a charge outlined in a federal criminal complaint related to his mailing 65 threatening letters to financial institutions from Amarillo in October 2008.

The indictment alleges that on October 18, 2008, Goyette mailed a letter to the attention of Jamie Dimon at JP Morgan Chase & Company, at 270 Park Avenue in New York, that contained threats of bombing and killing people at the JP Morgan Chase & Company’s corporate headquarters within six months. The criminal complaint filed in the case stated that the threat in this letter included the threat of “McVeighing of your corporate headquarters within six months.” This letter also threatened to “utilize any strategy and tactic to inflict financial damage to your company.”

The indictment further alleges that Goyette mailed 64 letters to 52 various locations of Chase Bank; Federal Deposit Insurance Corporation (FDIC) offices in Arlington, Virginia; Washington, D.C.; and Dallas, Texas; and Office of Thrift Supervision (OTS) offices in Chicago, Illinois; Daly City, California; Jersey City, New Jersey; Washington, D.C.; and Irving, Texas. Each of these letters contained an unknown white powder and the threat that the person breathing the powder would die within 10 days.

SHOULD THE FEDERAL JUDGE BE IMPEACHED?

ONE CONGRESSMAN THINKS SO!

A ranking congressional judiciary committee Republican said Tuesday he will call for the impeachment of U.S. District Judge Samuel Kent, who pleaded guilty to obstruction of justice this week.

U.S. Rep. James Sensenbrenner, R-Wis., said Tuesday that once Kent has been sentenced he will introduce a resolution to impeach the 59-year-old jurist who is seeking to retire with full pay. Kent is scheduled to be sentenced in May. Prosecutors have asked he serve three years in prison.

“Felons don’t belong on the bench or in Congress,” said Sensenbrenner, a former chairman of the House judiciary committee.

The congressman called it outrageous that Kent is asking to retire under a disability exception so he can keep collecting a federal paycheck for the rest of his life.

“Nobody should be paid by the taxpayers for sitting in jail and not hearing a case,” he said. “And if his honor wishes to avoid the embarrassment and expense of impeachment, he should resign.”

Federal district judges are appointed for life. When they retire at 65 — or earlier, if disabled — they continue to receive the same pay as their retirement benefits. Judges lose these privileges only if they resign or are impeached.

Sensenbrenner said another federal judge, Walter Nixon of Mississippi, was sent to prison for tax evasion. Nixon, who refused to resign, was disbarred and still tried to retake the bench before being impeached.

He worries that Kent could retire on disability, then claim he was cured after a prison term and try to retake the bench, too.

BORDER PATROL AGENT ACCUSED OF SMUGGLING ILLEGALS INTO THE COUNTRY: ARE YOU SHOCKED?

Sergio Lopez Hernandez, 40, a Brownsville Customs and Border Protection (CBP) inspector was indicted by a federal grand jury on Wednesday Feb. 18, 2009 , according to a sealed 11-count indictment that was partially unsealed yesterday by U.S. Magistrate John R. Froeschner, acting United States Attorney Tim Johnson announced today. Hernandez was arrested on Jan. 28, 2009 , and appeared the following day before U.S. Magistrate Felix Recio who ordered him detained without bond. 

Count one charges that from July 2008 to on or about Jan. 28, 2009 , Hernandez and others did knowingly and willfully conspire to bring illegal aliens to the U.S. and transport them in furtherance of their illegal presence in the United States . They are also charged with bringing an illegal alien to the United States (counts four through six) and transporting and moving an illegal alien within the United States (counts two and three) from near Los Indios, Texas, to near Brownsville, Texas, for commercial advantage and private financial gain. As a public official, that is, an officer with the Department of Homeland Security-CBP, Hernandez corruptly demanded, sought, received and accepted a thing of value to influence an official act - to allow an illegal alien to enter the United States . The bribery charges in counts seven through nine charge Hernandez with accepting in excess of $150,000. Hernandez is further charged in counts 10-11 with Francisco Mejia-Fajardo of knowingly and intentionally conspiring to possess with intent to distribute and possession with intent to distribute approximately 15 kilograms of cocaine on Jan. 28, 2009 .

The Indictment also gives notice seeking the forfeiture of certain vehicles used in the commission of the offenses and the forfeiture of $85,250 seized from Hernandez Jan. 28, 2009 .

Counts one through three of the indictment are each punishable by imprisonment for up to 10 years and a fine of up to $250,000, while counts four through six are each punishable by imprisonment for not less than three nor more than 10 years and a fine of up to $250,000. Counts seven through nine are each punishable by imprisonment for up to 15 years and a fine of up to $250,000. Counts 10-11 are each punishable by imprisonment of not less than 10 years up to life and a fine of up to $4,000,000.

The case was investigated by Brownsville FBI agents and Harlingen Customs and Border Protection Office Of Professional Responsibility.

THREE ATLANTA POLICE OFFICERS SENT TO PRISON FOR SHOOTING AND KILLING 92 YEAR OLD!

David E. Nahmias, United States Attorney for the Northern District of Georgia, announced that three former Atlanta Police Department (APD) officers were sentenced to prison today by Chief United States District Judge Julie E. Carnes on a charge of conspiracy to violate civil rights resulting in death, arising from the fatal police shooting of Kathryn Johnston, a 92-year old Atlanta woman, at her home during the execution of a search warrant obtained by the defendants based upon false information on November 21, 2006.

JASON R. SMITH, 36, of Oxford, Georgia, was sentenced to 10 years in federal prison. GREGG JUNNIER, 42, of Woodstock, Georgia, was sentenced to six years in federal prison. ARTHUR TESLER, 42, of Acworth, Georgia was sentenced to five years in federal prison. There is no parole in the federal system. Each defendant was also sentenced to serve three years on supervised release following his prison term, and collectively to pay $8,180 in restitution for the costs of Ms. Johnston’s funeral and burial.

In a brief news conference after the sentencing hearings, United States Attorney David E. Nahmias said in part, “As Atlanta police narcotics officers, these three defendants repeatedly failed to follow proper procedures and then lied under oath to obtain search warrants. Their routine violations of the Fourth Amendment led to the death of an innocent citizen. The death of Kathryn Johnston in a police shooting was a terrible tragedy for a law-abiding elderly woman, her family, and friends and our entire community. But as her family and others hoped, from this tragedy have come two positive results. First, it has led the Atlanta Police Department to implement useful reforms in training and supervision and to entirely revamp its Narcotics Unit, reducing the possibility of a similar tragedy in the future. Second, the significant prison sentences imposed by the Court today should send a strong message to other law enforcement officers who may be tempted to lie under oath or otherwise violate the law. Officers who think, as these defendants once did, that the ends justify the means or that ‘taking shortcuts' and telling lies will not be discovered and punished should realize that they are risking their careers and their liberty. And officers who try to obstruct justice when their misconduct faces exposure, rather than cooperating in the investigation, should realize that they will face even more severe punishment.”

In Washington D.C. Acting Assistant Attorney General Loretta King said, “The Justice Department is committed to vigorously prosecuting law enforcement officers who willfully disregard the Constitution and abuse their authority to violate the rights of others. This sort of unlawful behavior, resulting in Ms. Johnston's tragic death, undermines the efforts of law enforcement officers who honorably perform their duties.”

JUNNIER and SMITH pleaded guilty to the federal civil rights conspiracy charge, as well as voluntary manslaughter and related state charges in Fulton County ( Georgia) Superior Court, on April 26, 2007. Pursuant to their plea agreements, they are scheduled to be sentenced in state court on March 5, 2009, to the same sentence imposed in federal court, with the sentences to be served concurrently. TESLER initially declined to plead guilty and was indicted in state court on charges of violation of oath of office by a public officer, false imprisonment and false statements. In 2008, TESLER was convicted at trial in state court on the false statement charges, but that conviction has been reversed on appeal. Following the state trial, federal authorities re-evaluated TESLER’S case, conducted further investigation, and determined that federal prosecution of TESLER was appropriate. TESLER pleaded guilty to the federal charge on October 30, 2008.

JUNNIER began cooperating truthfully with authorities shortly after the federal investigation began and provided valuable assistance in the investigation and prosecution of SMITH and TESLER. Additionally, JUNNIER’S cooperation led to guilty pleas to federal charges by two additional APD officers, including a separate civil rights offense committed by the sergeant who commanded the narcotics team involved in the shooting. SMITH cooperated to a more limited extent. Both former officers provided information relevant to a broader FBI investigation of misconduct by APD narcotics and other officers, which culminated in a report provided by the FBI to APD Chief Richard Pennington in October 2008 for consideration of potential administrative discipline against other APD officers. As a result of their cooperation, the Court reduced JUNNIER’s sentence by 40 percent and SMITH’s sentence by 20 percent. TESLER did not provide substantial assistance in the investigation and received no sentence reduction on that ground, although his sentence was reduced based on his lesser role in the conspiracy.

On Tuesday President Barack Obama says beginning April 1st all of us who make under $250,000 a year will be getting a tax break.  I did a little research to see how much of our check we will get to keep.  The amount comes out to about $65 a month.  That's the amount the average family won't have to pay in federal taxes.  Is it enough to make a difference in your life?  And how much did you expect him to give the average family in tax breaks?

It was Louisiana Governor Bobby Jindal's chance to shine on the national scene as he provided the Republican's response to President Barack Obama's first Congressional address.  Governor Jindal is my homeboy from Baton Rouge.  He was just a year behind me in school and a year younger so I was very proud to see him get so much national exposure.  But what do you think of his speech? I listened to a CNN reporter Tuesday night who said one Congressional member rose very early Tuesday morning to ensure he got a good seat at President Barack Obama's first address to Congress.  That Congressman from New York apparently showed up at 8am in the morning to get an aisle seat for a speech that wouldn't take place until 12 hours later.  One CNN anchor said he apparently didn't have anything to do.  Well, The Insite wanted to know what time our Houston delegation got to Capitol Hill.  I noticed Congressman Al Green and Congresswoman Sheila Jackson Lee both had the highly coveted aisle seats.  Both also shook hands with the US Supereme Court Justices and President Obama.  They apparently got there early so I want to know what time do you think these Texas lawmakers made it to the Captiol to get their seats?  The Insite would like to hear your opinion!

It's beginning to look like Rodeo time in Houston.  Just as the streets are seeing their last parades in Louisiana for Mardi Gras the Texans in Houston are rolling out the cattle.  There were actually long horns at City Hall Tuesday as the Houston Rodeo Round Up kicked off rodeo season in the Bayou City.  Mayor Bill White was on hand for the big announcement along with lots of rodeo officials and the very hard working volunteers.  Many of the big events begin near the end of the week with the big barbecue and parade.  So make sure you get your programs for all the events coming in this year's Houston Livestock Show and Rodeo.  It's about to become a whole lot of fun around town!

HIS FIRST ANNUAL ADDRESS TO CONGRESS!

President Barack Obama says he wants to raise the pay of America's fighting forces and improve health care and benefits for veterans.

The president also says he will soon announce a way to responsibly end the war in Iraq and a new path for the war in Afghanistan. Defense and foreign policy were a small part of Obama's first address to Congress on Tuesday that focused on the economic crisis.

Obama did not give specifics, but he said his new budget proposal for next year will provide for an expansion of the armed forces and increases in their pay and benefits.

Obama says his plan to close the Guantanamo Bay prison will make the country stronger.

Obama says he will also seek what he calls swift and certain justice for terrorists.

IT COULD TURN INTO A HOME INVASION OR BURGLARY!

These solicitors just won't stop.  I thought the last place I'd see them was at my house way up north.  Boy, was I wrong.  I was at home Monday when I heard some guy snapping his fingers, singing, dancing and knocking at the front door of my house.  I had a pretty good idea it was no one I knew because I could see through my glass front door. So, I didn't answer.  About 20 minutes later there was another doorbell ring.  It looked like someone from that same group.  I still didn't answer because I knew it was some kind of scam door to door sales.  Usually, it's magazine sales or a fake ministry.  I finally decided to go to the front door after the last irritating ring but by the time I made it the person was getting into this white van.  It was a vehicle loaded with people.  People who have that ruffled but attempting to appear professional look.  Usually, there's a tie not tied quite right on the guys, a dingy white shirt, very worn shoes and pants that aren't quite pressed.  About an hour later I saw the same van at the Exxon in the Woodlands.  It was a gang of people who apparently were bused in to solicit and go door to door in my neighborhood.  I think I'm going to put a sign on my door reading no soliciting. These people may be dangerous or try to come back later and burglarize your home.  I suggest everyone out there take precautions if or when you go and answer that front door.  There are too many home invasions to just invite a stranger in.  The Insite has warned you!

What's going on with Mayor Bill White in his last days in office? For years White couldn't be caught making a mistake when it came to city government and his leadership in Houston. But since the beginning of the year there's been one controversy after another for the Mayor and his administration. It makes some wonder if he's still calling the shots down there on Bagby. First, there was the fiasco involving the Mayor's endorsement of a downtown luxury apartment complex.  It was built by one of White's campaign contributors.  Secondly, who can forget the HOPE campaign where White purchased an ad in the Houston Defender and then his staff approved the placement of White in between Dr. King and President Obama. There's also the computer system crash at Municipal court a few weeks ago on White's watch. That followed the nightmare of more than 3,000 HPD officers who didn't get their W-2 forms because of a problem with a computerized payroll system that came in White's administration.  Now, there's this Housing Credit Score Enhancement program. Not even a first term city council members would touch that political fireball. But Mayor White somehow found himself right in the middle of all of these issues.  I can't quite figure out what's going on. I'm wondering if there is some type of conspiracy to sabotage the Mayor in his final months in office.  If you have any answers as to what's going on please let the Insite know!

THE MONEY CAN'T BE USED FOR CAR LOANS OR CREDIT CARD DEBT ACCORDING TO THE MAYOR'S OFFICE!
The City Council will consider a proposal to use taxpayer money for paying down debt of first-time homebuyers trying to qualify for a mortgage through Houston's assistance program.

The "Credit Score Enhancement Program" would give up to $3,000 for individuals to use on such debt as student loans or hospital bills according to the Mayor's office. Frank Michell with the city says the funds can not be used to pay down debt on car loans or credit card balances. City officials believe the debt reduction could provide the slight boost in credit scores some applicants need in a tighter credit market.

The $444,000 for the program would come from leftover money in the city's $1.5 million appropriation for emergency home and roof repairs from Hurricane Ike, the Houston Chronicle reported Tuesday.

Councilwoman Anne Clutterbuck said the program was well-intentioned but went too far.
"If this credit crisis has taught us anything, we need to focus on paying off our debts and saving more," she said. "Using government money to help someone pay off debts is not the same as asking them to pay off their debts themselves."

Houston has three grant programs to help qualified homebuyers with down payments and closing costs. The most generous provides up to $37,500 to buy a home that costs $135,000 or less in disadvantaged neighborhoods the city is trying to revitalize.

MARDI GRAS HOUSTON STYLE!


THE PARTY THROWN BY LACHANDA, JULIE AND OTHERS!

















Sunday night the Insite made a stop by the big Mardi Gras party that attracted a very large crowd in Houston. It was given by LaChanda Jenkins, Julie Griffith and friends. The sounds of New Orleans could be found blasting in the venue and beads were around every ample neck including mine at Cafe 4212 on Almeda. It was time to let the good times roll as best we can in Houston. The party was the alternative to those who could not make it to the Big Easy for Mardi Gras or the grand finale we know as Fat Tuesday. I ran into a lot of familiar faces such as Lanchanda Jenkins, Julie Griffith, Duarte Geraldino, Michael Jones, Sherry Jessup, Laquinta Williams, Michelle Jefferson and the list goes on. I want to thank everyone who stopped and possed for the Insite. Happy Mardi Gras!

Students can also enter their original film projects into the annual film competition to be judged by John and his panel, with the winner to be announced at the conclusion of the event. John “Dr. Teeth” Tucker, founder of J.D. Tucker Foundation, initially created the festival as a vehicle to equip Film and Communication students at Historically Black Colleges & Universities with resources that are not always obtainable to them and their schools. “The primary goal of the festival is to expose students to every possible opportunity that the film and television industries have to offer.

The event affords each participant access to a body of knowledge rarely available,” Tucker explains. “As a graduate of Texas Southern University it is important to me to share knowledge and experiences that will help prepare them for the reality of the business, and if I am able to help just one person then I have succeeded,” he goes on to state. It is this acknowledgement and acceptance of his social responsibility that has the famed director pooling all of his resources to make this year’s event the best one ever.

The Insite dropped by the birthday party of Houstonian Mini Tammaraju. The big bash was held at the Usual place just off I-10. The party was a blast because many of the guests took to the stage at the bar and belted out the best karaoke song. Of course the Insite was just there to document all the entertainment and not make a fool out of myself. Lots of familiar faces attended the event including Jessica 'Party Queen' Michan, Miya Shay, Sejal Brahmbhatt, Sandra Puente, as well as Mr. and Mrs. Gordon Quan to name a few. Happy birthday Mini!

HE'S A BALL OF ENERGY WITH A NEW CAREER ALREADY!
The Insite finally had a chance to meet the world famous Michael T. on last week. His father, talk show host Michael Berry, brought him by the FOX 26 studios on Friday. He and his Mom Nandy Berry came to watch Michael record his FOX Face Off segments which airs on the Friday afternoon newscast. Michael T. was a ball of energy in the newsroom. He was all over the place. I think he also found his future career when he sat on the anchor desk. He was a natural there. Hey Lil Mike, thanks for dropping by the Insite!
