The lawsuit alleges that Nico's Mediterranean Grill in Webster, Texas, is infringing Niko Niko's registered service mark. According to the legal complaint, Nico's Mediterranean founder Nicos Zanicos has misled customers to falsely believe that his restaurant in Webster is part of the Niko Niko's family, and that the untrue claims have been repeated on several popular restaurant review websites.
The lawsuit says Mr. Zanicos deliberately deceived customers in an attempt to capitalize on the popularity of Niko Niko's. Mr. Zanicos previously sought to franchise with Niko Niko's, but was turned down before opening up the competing restaurant in late 2010, according to the court filing.
Niko Niko's is represented by AZA name partner John Zavitsanos and firm associate Tiffany Isaac.
The lawsuit, Niko Niko's LLC v. Nico's Mediterranean Grill, No. 4:11-cv-776, was filed Friday, March 4, 2011, in the U.S. District Court for the Southern District of Texas in Houston.
